How it Works

Every individual and family is unique. That is why I offer a flat fee process that is customized to your particular situation and needs. Whether you are a client that feels like you need support navigating parts of the process such as arranging mortgage financing or gathering financial documents, or you are a client who has your income information organized in chronological order ready to upload, I want to tailor my services to best suit your needs. For some steps/tasks you may need more support than others. That is why I offer a flat fee process that is unique to your needs and particular situation.

Durning the initial consultation we will review your situation and your goals. If we determine that a flat fee is appropriate for your matter I will provide you with a flat fee structure for you to consider. There is always the option to chose an hourly rate structure.

It is my hope that offering a flat fee structure will give clients some certainty during what is typically an uncertain time. I can understand that in todays world budgeting and planning for any expense is extremely important.

Disbursements (photocopying, courier fees, court filing fees etc) and taxes are not included in the flat fee amount. My practice is primarily virtual and I attempt to be paperless as much as possible to reduce fees and the impact on the environment.

Below I have listed some common family law matters that can be completed on a flat fee basis. During our consultation I will be able to better ascertain whether a flat fee is appropriate for your matter. After our consultation I will define the flat fee cost for your unique situation.

 

Uncontested Divorce

 

Where parties already have a Separation Agreement (or in the rare case do not need one), a divorce can be resolved on an uncontested basis, which means the party seeking a divorce will ask the Court for a divorce only. No relief is pronounced by the Court except a divorce.

You will require an original marriage certificate to proceed with filing for a divorce. If you were married in Manitoba you can order a certificate from Vital Statistics.

 

Separation Agreement


Where parties have their financial disclosure in order and are generally on the same page as to the terms of a Separation Agreement, the Agreement can be drafted on a flat fee basis with minor involvement from lawyers to assist resolving any outstanding issues. Independent legal advice is provided throughout the process. The other party will require their own lawyer to provide them with independent legal advice. The flat fee includes time spent after the Agreement is signed to assist with any follow up tasks such as registration of pension waivers, transfer of investments or ensuring refinancing is completed by real estate counsel.

The flat fee cost for this service will vary depending on whether there are children involved.

If you require a lawyer to assist with negotiating some terms of an Agreement, including the drafting of the Agreement and follow up as set out above, this can be arranged on a flat fee basis.


Cohabitation and Pre-Nuptial Agreement

Prior to or after reaching the status of common law, or being married, parties can enter into a mutual Cohabitation and Pre-Nuptial Agreement.

The flat fee includes drafting the Cohabitation and Pre-Nuptial Agreement as well as all meetings (to provide you with advice on terms to consider including in the Agreement and signing meeting) and independent legal advice on the agreement reached.


Independent Legal Advice on a Drafted Agreement

Has the other party had their lawyer draft a Separation Agreement or a Cohabitation and Pre-Nuptial Agreement? If so, there could be significant consequences to you if you do not seek out your own independent legal advice (“ILA”). In addition, both parties require their own independent legal advice to ensure the agreement is long lasting and binding.

ILA can be provided on a flat fee basis and the range depends on the degree of changes or negotiation assistance that is needed.

The flat fee cost for this service, includes reviewing the draft Separation Agreement, providing advice, and discussions with the other lawyer regarding any changes, as well as witnessing the signing of the Agreement.
